AZ Legislative Update – May 12, 2022
Today marks the 123rd day of the Arizona 55th Legislature, 2nd Regular Session. Of the 1,780 bills introduced this year, the Legislature has now passed 233 with Governor Ducey signing 228 and vetoing none.
While a FY 2023 budget agreement is certainly not imminent, we are hearing that legislative leadership and the Governor’s Office have made significant progress over the last week. That being said, securing the necessary votes (16 in the Senate/31 in the House) still remains the biggest obstacle moving forward.
Once again, both legislative chambers had an abbreviated work schedule this week with the House only working on Monday and the Senate adjourning on Tuesday. The number of bills waiting floor action continues to dwindle and the level of floor activity remains quite slow as the budget continues to be negotiated.

Notable Legislation
HB 2599 Administrative Hearing; GRRC (Grantham): HB 2599 passed out of the Senate on Monday, 17-10, on reconsideration. The bill updates the Office of Administrative Hearing (OAH) process by eliminating the unfair unilateral authority for state agencies to overrule an administrative law judge’s decision and allows businesses to recover attorney fees and costs if successful at OAH. The bill also streamlines the appeals process when the third parties are appealing an agency decision. Additionally, it makes several modifications to the GRRC appeal process by modernizing procedures and leveling the playfield for the business community.
